This Privacy Notice for OutScout, Inc. (“we,” “us,” or “our”), describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use our services (“Services”), including when you visit our website at https://www.outscout.io, use our talent-recruiting platform, or engage with us in other related ways including sales, marketing, or events.

  • Do we process sensitive personal information? We do not intentionally collect or request it, and we ask that you not include it in a resume or submission unless necessary. See Section 1.
  • Do we collect information from third parties? Yes. We obtain business contact information from third-party data providers, and we use artificial intelligence and other service providers to help us process information we already hold, such as parsing resumes and summarizing candidate profiles. A current list of the specific service providers we use is available to clients and data subjects on request. See Section 1 and Section 6.
  • How do we process information? To provide, improve, and administer our Services, to communicate with you, for security and fraud prevention, and to comply with law.
  • Sharing? In specific situations with specific third parties described below.
  • Safety? We employ adequate technical and organizational measures to protect your personal information, though no method of transmission or storage is 100% secure.
  • Rights? We honor deletion and objection requests for any contact, candidate or otherwise, regardless of location, on request. See Section 11 for additional rights available to US state residents.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us. We collect personal information that you voluntarily provide when you apply as a candidate, register for or use the Services, or otherwise contact us. This may include: names, phone numbers, email addresses, mailing addresses, job titles, employment and career history, resumes/CVs, usernames, passwords, and contact preferences. If you make a purchase, we (or our payment processor) also collect billing information such as billing address and payment card details, which is handled by our payment processor and not stored by us directly. We do not intentionally collect or request sensitive personal information (such as health data, racial or ethnic origin, or religious beliefs), and we ask that you not include it in your resume or other submissions unless necessary. If sensitive personal information appears in materials you submit, we do not use it to make decisions about you or for any purpose incompatible with providing the Services.

Information from third-party data providers. We obtain business contact information, including name, job title, employer, and business contact details, from third-party data providers. We use this information to identify and contact potential candidates and business contacts about opportunities. We obtain a personal email address or mobile phone number only when we intend to contact someone directly about a specific role. You may ask us to remove your information or to stop contacting you at any time by emailing contact@outscout.io. When you do, we delete your information and retain only the minimum necessary to ensure we do not contact you again.

We also use artificial intelligence and other service providers to help us process information we already hold, such as parsing resumes and summarizing candidate profiles. See Section 6 for more on how we use these tools. A current list of the specific service providers we use is available to clients and data subjects on request by contacting contact@outscout.io.

Information automatically collected. We automatically collect certain information when you visit, use, or navigate the Services, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, and information about how and when you use our Services. We may also collect approximate location information (e.g., city/region derived from IP address) via cookies or similar technology. This information is primarily needed to maintain the security and operation of our Services, and for internal analytics and reporting purposes.

2. HOW DO WE PROCESS YOUR INFORMATION?

We process your personal information for a variety of reasons, depending on how you interact with our Services, including to:

  • Facilitate account creation and authentication.
  • Deliver and facilitate delivery of Services, including matching candidates to open positions and presenting candidate information to hiring teams.
  • Respond to user inquiries and offer support.
  • Send administrative information, such as updates about our Services, security, and changes to our terms and policies.
  • Enable user-to-user communications, where applicable.
  • Protect our Services, including monitoring for and preventing fraud and abuse.
  • Comply with our legal obligations.

3. WHAT IS THE BASIS FOR OUR PROCESSING?

We process personal information to provide and improve our Services, communicate with you, protect our Services against fraud and abuse, and comply with applicable law. This includes using business contact information obtained from third-party data providers to reach out about potential opportunities, as described in Section 1. You may ask us to stop contacting you or to delete your information at any time by contacting contact@outscout.io.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We may share your information in the following situations:

  • Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
  • Service providers. We share information with vendors who help us operate the Services under contract, including providers who help us process resumes and candidate information (see Section 6), a provider who sends account and notification email on our behalf, and providers who host our Services and store our data. These providers are contractually restricted to processing information only as needed to provide services to us, and are not permitted to use it to train their own models. We may change our service providers at any time.
  • Business partners. We may share information with our business partners to offer certain products, services, or promotions.
  • As required by law or to protect our rights. We may disclose personal information where required by law, legal process, or governmental request, and to establish, exercise, or defend legal claims.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We may use cookies and similar tracking technologies (such as web beacons and pixels) to gather information when you interact with our Services. We use two categories of cookies: strictly necessary and functional cookies, which maintain the security of our Services, prevent crashes, fix bugs, and save your preferences, and analytics cookies, which help us understand how the Services are used. We also permit third parties and service providers to use tracking technologies to help us analyze traffic and usage of our Services. We do not use the Services for targeted or cross-context behavioral advertising. You can control cookies through your browser settings, and you can opt out of Google Analytics tracking via Google’s browser add-on.

6. HOW DO WE HANDLE YOUR INFORMATION WHEN YOU USE OUR AI-BASED PRODUCTS?

We use artificial intelligence and machine learning tools to help process and organize information, including parsing resumes, summarizing candidate profiles, and matching candidates to open roles. Automated processing alone does not determine any decision about a candidate. Our talent partners review the information and make decisions. We do not use automated systems to contact candidates.

We engage these providers under agreements that permit them to process information only to provide services to us and prohibit them from using it to train their models. Information sent to them is retained only for the limited period necessary to provide the service and is then deleted.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

We retain personal information for as long as necessary to provide our services and for legitimate business purposes, and for longer where necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

You may request deletion of your personal information at any time by emailing contact@outscout.io. When we receive a request, we delete the information we hold about you and retain only the minimum necessary to comply with our legal obligations and to ensure we do not contact you again.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

9. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to their use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. 10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. Because we do not sell personal information and do not use it for targeted or cross-context behavioral advertising, there is generally nothing for a DNT-style signal to opt you out of. That said, where we are required to honor a recognized universal opt-out preference signal, such as Global Privacy Control, we will do so. If a uniform standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this notice.

11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have additional rights under applicable state privacy laws.

  • California Customer Records information: Yes
  • Protected classification characteristics: No
  • Commercial information: No
  • Biometric information: No
  • Internet or other similar network activity: Yes. Browser, device, and usage data collected via cookies and other tracking technology (Section 5).
  • Geolocation data: Yes. Approximate location derived from IP address (Section 1).
  • Audio, electronic, visual, or similar information: No
  • Professional or employment-related information: Yes. Includes candidate career history and business contact information, such as title, employer, and work email, obtained from third-party providers.
  • Education information: No
  • Inferences drawn from other personal information: Yes. E.g., AI-generated candidate summaries (Section 6).
  • Sensitive personal information: No, not intentionally collected. We do not request sensitive personal information and ask that submissions not include it unless necessary; see Section 1.

We have not sold or shared personal information to third parties for a business or commercial purpose in the preceding twelve months. We have shared personal information with service providers under contract to provide our Services, and we have received business contact information from third-party data providers. These contracts do not permit our service providers to use your information for their own independent purposes. A current list of the specific service providers we use is available on request by contacting contact@outscout.io.

Your rights under these state laws may include the right to: know what personal information we process; access your personal information; correct inaccurate personal information; request deletion of your personal information; obtain a copy of the personal information you previously shared with us; be non-discriminated against for exercising your rights; and opt out of the processing of your personal information for targeted advertising, the sale of personal information, or profiling.

Depending on the state, you may also designate an authorized agent to make a request on your behalf, and some states provide additional rights around appeals of a denied request.

12. DO WE MAKE UPDATES TO THIS NOTICE?

Yes, we will update this notice as necessary to stay compliant with relevant laws. The updated version will be indicated by an updated “Last updated” date, and the updated version will be effective as soon as it is accessible. If we make material changes to this notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.

You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.
